I'm sure everyone has heard of the issues about the virtual consoles and some of the games that would appear on it. Such as the games made by the microsoft owned Rare Studios. These games include
Goldeneye 007
Donkey Kong 64
Conker's Bad Fur Day
Diddy Kong Racing
Donkey Kong Country
Donkey Kong Country 2
Donkey Kong Country 3
Banjo Kazooie
banjo Tooie
Jet Force Gemini
All of these titles were made before microsoft bought out Rare Studios and I've got news for nintendo, If it was made before the buyout, they still have rights to it. So Nintendo can still make all these games and transfer them to the virtual console and sell them. The only minor issue is to get Rare to translate the game so it is playable on the virtual console. I don't see a problem with this as Nintendo does still own the rights to the games.

It's a good thing that this rule exists. I can't see why it's a problem anymore then.

It doesn't matter when they were made if Rare owns the rights to the characters and game license, which in a lot of those cases, they do.

"Translating" the games wouldn't be an issue as they're most likely using an emulator, probably with some sort of DRM system thrown in.

Actually, the reason WHY Goldeneye is a problem is the Bond Licence which EA currently has a stranglehold over right now.
Nintendo also wants Rare's approval even though they do not have to get it.
And since Rare is now totally owned by Microsoft, that is a bit hard...
And the reason on why they can't just bring over the Banjo games is because the characters are not owned by Nintendo like Novasol said.
The games being made before the buyout isn't the issue here...
Its also why Nintendo was able to remake the Donkey Kong Country games already since they control the characters in the game...

I thought Rare was making games for the DS? So they should have a department or two that could work on the Wii...

Nintendo owns the various Donkey Kong characters, so I imagine they'd have few troubles VC'ing DK games.

I thought Rare was making games for the DS? So they should have a department or two that could work on the Wii...Rare can make DS games because the Nintendo DS isn't competing with Microsoft, the owners of Rare, in it's market. Microsoft has no handheld consoles, so Rare producing DS games doesn't incur a conflict of interests. Not so with the Wii. The Wii is enough in the same market as the XBox that it would be competing.

Hell, Microsoft makes games for the DS, Mechwarrior and AoE I believe.
