The catch? You'll lose access to Live and any other network features until the 19th.

This is the beta version that people are currently testing. I have no idea how it got out, but it's out. The general consensus seems to be that you won't get banned from Live for doing this so it's fairly safe. Curious? Look here: http://digiex.net/homebrew/594-xbox-...-download.html

How is that 'probably lose' access, unless you think everyone has hacked/modded XBoxes sitting around and are piriting the beta left and right.

Guess you're right! Just fyi you can do this without modding your 360, since it can be done via the normal offline update procedure, so it's pretty legit. And as you can see MS theirselves said that the only thing that would happen to an unregistered 360 with this update would be that they'd lose access to Live until the 19th.
